All references to “Bliss Pilates” are references to the owner(s) of the business trading as “Bliss Pilates”. By booking a class at Bliss Pilates you agree to and abide by ‘Bliss Pilates Terms & Conditions’. Please read these Terms & Conditions thoroughly and carefully before proceeding

GENERAL RISKS AND WAIVER

Pilates and Yoga classes may involve risk of personal injury. In attending all Bliss Pilates classes, you agree that Bliss Pilates is not liable for any injury, loss or damage to you, or your property during or in connection with any Bliss Pilates class or while on any premises or in any venue in connection with any Bliss Pilates class.

STUDIO POLICIES

Bliss Pilates may close on major public holidays, Easter and Christmas or at any other time. If we have to close on a day classes have been scheduled, we will endeavour to provide as much notice as possible.

You must be at least 16 years of age to attend the adult group classes.

All the sessions purchased (including but not limited to) intro passes, casual passes and all types of class passes options have a relevant expiry date. It is your responsibility to be aware of the expiry date and Bliss Pilates does not take any responsibility for managing or extending the expiry dates, it not Bliss Pilates obligation to remind or notify you of any session purchase expiry.

Bliss Pilates does not offer refunds for any reason so please choose your options carefully. Bliss Pilates reserves the right to refund any purchases wholly or partially at its sole discretion.

You agree to use the studio facilities, equipment and services in an appropriate and safe manner. You agree to follow the instructor’s instructions at all times and you agree to be liable for any damage caused by you or your dependents through a wilful act or negligence.

A letter of compliance from your doctor or obstetrician is required prior to attending any pregnancy classes or if you have a rehabilitation objective in doing Pilates.

It is your duty to inform the instructor of any injuries or concerns, prior to attending the class. If you are unwell, we ask that you do not attend any Bliss Pilates classes. Bliss Pilates reserves the right to request any unwell class participants to leave for the health and safety of Bliss Pilates staff and other class attendees. In the regrettable event you have to leave a class due to illness, no refund or credit will apply.

Phones should not be used during class and if you need to do so, please be respectful to other attendees and use your phone in a discrete area away from others.

Grip socks are compulsory in ALL the reformer classes for hygiene and safety reasons.

Please bring your own mat or they are available for rent at $2 each.

We aim to commence and finish the scheduled class at the designated times so please arrive at least 10 minutes prior to the scheduled start time.

You are responsible for notifying Bliss Pilates should you change your personal details, including address, phone number, email, emergency contact details and payment details (bank account and / or credit card information).

Subject to any legal restrictions, staff members reserve the right to restrict or refuse to admit any attendee at his or her discretion for reasons including but not limited to health and safety, inappropriate behaviour or poor personal hygiene.

BOOKINGS AND WAITLIST

Bookings:

All classes at Bliss Pilates must be booked and paid online prior to attending. Intro passes are activated on the date the first class is booked. Class and intro passes will not be extended other than at the absolute discretion of Bliss Pilates. Class bookings are not transferrable.

Waitlist:

Our waitlist system is automated and if a place becomes available you will receive a notification via email that you have been moved into the class. If you are on the waitlist and eventually secure a spot in a class, the same cancellation and no show policy applies. Please ensure you cancel the session if you are unable to attend.

All bookings and cancellation can be made via the booking system on our website or through our nominated app on your mobile device.

CANCELLATION/NO SHOW

On very rare occasions it may be necessary for Bliss Pilates to cancel classes with or without prior notice. Bliss Pilates will provide as much notice as possible via text, email and call. It will be your responsibility to ensure we have an up to date and active contact details (mobile number and email address) for this purpose. In the event of a cancellation, a replacement class will be offered where possible at a later point in time. In the event that a replacement class cannot be arranged you will not be charged for the cancelled class.

Cancellation:

Other than for genuine emergencies, the full fee for all class types or the use of your Class Pass will be deducted for “no shows” or cancellations within 6 hours of class start time. The period is 24 hours for Private and Semi-Private sessions.

For those with Unlimited Memberships, a fee of $10 will be charged for a “no show”.

If Bliss Studio closes or cancels classes due to Government policy or restrictions (e.g. relating to COVID), all memberships, class passes and purchases will be suspended for the duration of the closure to a maximum of 12 months, in effect putting your membership and purchases on hold until you are able to utilise them again.

MEMBERSHIP AGREEMENT TERMS AND CONDITIONS

Our memberships have a minimum three month term. Memberships will be renewed automatically unless a cancellation request is received in writing. Memberships are non-refundable and non-transferable.

Once the minimum term (three month) has expired, members may cancel the membership by giving 3 weeks notice in writing. The membership payment will continue to be debited for the 3 weeks notice period.

Under special circumstances (e.g. medical emergencies), Bliss Pilates may agree to cancel a membership and waive the usual terms at its sole and absolute discretion.

Sessions can be booked up to one month in advance from the Membership debit date.

The term of a membership will not be altered due to the presence of public holidays etc.

Memberships may be temporarily suspended if a written request is received by Bliss Pilates at least 7 days prior to the start of the proposed suspension period. The suspension term must be in weekly increments and the maximum suspension term is three weeks.

Memberships commence on the date of purchase. Members agree to a weekly direct debit payment system (administered via Stripe) and should be aware that Stripe will charge a fee on declined payments of $2.50 per failed attempt. A maximum of 4 failed attempts will be made by Stripe.

A fee of $10 will be charged for a “no show” (i.e. if you book a class and fail to attend without cancelling at least 6 hours prior to class commencement).

A fee of $10 will be charged on the second “late cancel” in one calendar month (i.e. if you book a class and cancel within 6 hours prior to class commencement).

Bliss Pilates reserves the right to terminate the membership and recover the money owing in full in the event direct debits are unsuccessful.

If your monthly debit is declined more than once in a calendar month, we will apply a fee of $15 to your account to cover the costs of resolving the declined payment. It is therefore your responsibility to make sure there is sufficient funds on the account and that the credit card details are up to date, to prevent a declined payment fee being charged.

Membership does not entitle a member to private or semi-private classes and these must be booked and paid separately.

INTRO PASS AGREEMENT TERMS AND CONDITIONS

The intro passes must be activated within one month of purchase or they will automatically expire. To activate your intro pass, simply book and attend a class . Intro passes are non-refundable and non-transferable.

The Intro Pass entitles you to unlimited classes for a 2 week period and you can book into any class upon purchase (except for private and semi-private classes).

The intro pass offer is only for new Bliss Pilates clients only.

Our cancellation policy applies to classes booked under an Intro Pass.

PHOTOGRAPHY, VIDEO/DVD, PROMOTION & WEBSITE RELEASE.

I agree when enrolling at Bliss Pilates that Bliss Pilates may take photos or videos during classes. I agree that Bliss Pilates may use photographs and videos of the students to promote the studio through various means including but not limited to flyers, websites, social media and advertising. I agree and consent to Bliss Pilates using photographs and videos of its classes for promotional purposes where those photographs or videos contain images or videos of me. Further, I acknowledge that Bliss Pilates will have all legal and beneficial rights in any such images or videos and I waive any and all claims which I may otherwise have in relation to those images or videos including, without limitation, any claim for any fee, royalty or similar payment.
